Regular Meeting—October 12, 2005

            The meeting was called to order at 7:30 PM following a public hearing regarding establishing a new fire land.

            Present were Mayor Mahoney, Trustees Kelts, Pascucci, Rocque, and VanDervoort; Attorney Varley, Treasurer Fletcher, Clerk O’Brien, and several concerned village residents.

            Trustee Kelts moved to waive the reading of minutes from the Sept. meeting.  Trustee Rocque seconded and the motion carried unanimously.

COMMITTEE REPORTS:

Trustee Pascucci—Plans have been approved for the new tennis court, which will be constructed  in the Spring of 2006.

Trustee VanDervoort—Reported on the success of Heritage Day in spite of the rain.  The Waterford Museum will be conducting walking tours on Oct. 22 and Oct. 29.  The report of the Public Works director includes street sign installation, street patching and catch basin repair.  The complete report is available from the Village Clerk.

            Trustee Rocque—The report from the Waterford Fire Dept. notes a total of 16 alarms which were answered during September.  The complete report is available from the Village Clerk.

            Trustee Kelts—Thanked Jean Lavigne for the large part she played in the success of our recent Village Sell-out.  Announced the first annual Pumpkin Festival to be held at the Visitor Center on Oct. 22.  Free pumpkins will be offered  and prizes will be given.

            Eric Hamilton representing Mohawk Towpath Byway gave a brief presentation and certificate of appreciation to the Village Board, citing their participation in the efforts to create a byway from Waterford to Schenectady.  He also displayed a placque which the byway committee had received from Washington.

            Attorney Varley reported on the status of the litigation against the gas station at 112 Broad St.  At present the judge has issued a stay order while an appeal is pending.

            The financial report for the month of September shows a balance in the checking account of $210,772,45 and the Money Mkt. Account of $255,954.71 for a total General Fund balance of $466,727.16.  The Special Projects Fund balance is $73,048.52.

            Unaudited utilities, $3,825.30; Payrolls, $5,164.77; and Section 8, $21,811.11.

There were 3 abstracts—General Fund, $32.799.42; Special Projects Fund, $12,457.34; CDBG Fund, $7,695.46.  Trustee Kelts moved to pay these bills upon approval of the department heads and the village board.  Trustee Rocque seconded and the motion passed unanimously.

            Mayor Mahoney reported that 5 sidewalks have been completed under the 2005 sidewalk program, and several others have applied.  The mailbox on the corner of Second and Middle St. will be removed due to continued vandalism.

            Trustee Kelts offered Resolution #       to adopt a local law amending Section

198-11(A) to add a new subdivision “10”: “to establish a new fire lane on the north side of the intersection of First and Division streets extending 40 feet west of the westerly line of the intersection.”  Trustee Rocque offered the second; all Trustees and Mayor Mahoney voted Yes.

            Trustee Pascucci offered Resolution #      calling for a public hearing on Wed., Oct. 19 at 7PM to hear comments about amending the local law re the senior housing district  on Washington Ave.  Trustee Rocque offered the second; all Trustees and Mayor Mahoney voted Yes.

            County Treasurer J. Christopher Callaghan presented a check to the Village in the amount of $18,590.00 as the village portion of a 5 million dollar county fund balance.

            Several in the audience addressed the board concerning noise and other complaints about the gas station at 112 Broad Street. They were advised to complain to the police department since the village was doing everything legally possible to force the station to close.   One resident requested that the season for Concerts in the Park be extended by a few weeks next year.

            As there was no further business, the meeting was recessed and the board went into an executive session at 8:18 PM.  No business was transacted following the session and the meeting was adjourned.

Special Meeting—October 18, 2005

             Mayor Mahoney called the meeting to order and the board immediately went into executive session to discuss a personnel matter.  All Trustees were present.

            At the close of the session, Tom Wright was appointed chief of the Waterford Fire Dept., John Fairclough was appointed first assistant chief of the department, and both were immediately sworn in by the Mayor.
